Please read this agreement carefully before installing or using the TAMGAMCAD application ("Software"). By downloading, registering for, or using this Software from the respective app stores ("Platform"), you are deemed to have legally accepted the terms below.

1. GRANT OF LICENSE AND RIGHT OF USE

TAMGAMCAD grants you a personal, worldwide, non-transferable, and non-exclusive limited license to install and use this Software.

• Free Version: Offers the basic features of the Software for free.
• Pro Version (Subscription/In-App Purchase): If offered within the application, users gain access to advanced additional features added to the application during their purchased package or active subscription period.

2. PRICING, PURCHASING, AND REFUND POLICY

TAMGAMCAD applies different pricing and licensing models depending on the platform (Mobile or Desktop) provided to the users. The rules and policies of the platform where you make your purchase shall apply.

A. Mobile Version (Google Play and similar platforms)

• Subscription Options and Auto-Renewal: Different subscription options (in-app purchases) such as monthly, yearly, or other periods may be offered within the mobile version of the application. Purchased subscriptions automatically renew unless canceled by the user at least 24 hours before the end of the current billing period.
• Cancellation and Refund Procedures: Subscription cancellations and refund requests cannot be made from within the application. Cancellations and refunds must be handled directly through the subscription management screen of the relevant app store (e.g., Google Play Store) and in accordance with that platform's refund policies.
• Restore Purchases: When a user changes their device or reinstalls the application, they can reactivate their previously made active subscriptions or Pro version rights free of charge using the "Restore Purchases" function within the application, provided they use the same app store account (e.g., Google account).

B. Desktop Version (Microsoft Store)

• Paid Download and Licensing: The desktop version of TAMGAMCAD is offered to users through the Microsoft Store as a one-time purchase (paid app) for a specified fee. This purchase grants the user the right to download the application and benefit from standard updates.
• Cancellation and Refund Procedures: Refund requests for purchases made through the Microsoft Store are strictly subject to Microsoft's own refund policy and terms of use. Refund requests must be managed directly through the order history of the user's Microsoft account, not through TAMGAMCAD.
• Reinstallation and Device Usage: The user may redownload and install the application without an additional fee on other compatible Windows devices logged in with the same Microsoft account used for the initial purchase (within the device limits permitted by Microsoft).

C. General Pricing, Promotions, and Right to Modify

• Launch Pricing: Free usage rights or discounted Pro package fees offered during the initial release phase of the software are special promotions exclusive to the launch and early access period.
• Right to Change Prices: TAMGAMCAD reserves the right to unilaterally update its pricing policy at any time in response to economic conditions, inflation rates, increasing infrastructure costs, or newly added features.
• Protection of Acquired Rights and Feature Updates: Price increases do not affect already paid and ongoing active subscription periods; no retroactive additional fees can be claimed from users. However, subscription renewals will be charged at the updated current prices. Furthermore, certain features currently offered for free may be moved to the Pro (Paid) version in future updates.

D. Independence of Cross-Platform Purchases

Subscription purchases made via Google Play and application purchases made via the Microsoft Store are completely independent of each other and are not interchangeable. Registering or logging into the application with the same email address on both platforms does not transfer the purchased license or Pro features from one platform to the other. To use Pro features on both platforms, the user must make a separate purchase in accordance with each respective store's rules (a subscription on Google Play, and a paid download on the Microsoft Store).

E. Termination

TAMGAMCAD reserves the right to cancel the license, restrict application access, or permanently delete the account without prior notice if it determines that the user has violated the terms of this agreement.

3. USAGE RESTRICTIONS

The user may not:

• Copy, rent, distribute, or sell the Software, license keys, or subscription rights.
• Reverse engineer or attempt to extract the source code of the Software.
• Use the Software for illegal, fraudulent, or intellectual property-infringing purposes.

4. INTELLECTUAL PROPERTY AND THIRD-PARTY SOFTWARE

• Ownership: All code architecture, designs, interfaces, and algorithms of the Software belong to TAMGAMCAD. The Software is licensed, not sold to you.
• Open Source: The Software may contain open-source libraries belonging to third parties. These components are subject to their own specific license agreements, and this agreement does not restrict the original license rights of such components.

5. USER CONTENT AND FEEDBACK

• Content Responsibility: The user is solely legally responsible for all projects and drawings created using the Software. TAMGAMCAD cannot be held responsible for user content infringing on the patents or copyrights of third parties.
• Ownership of Feedback: Any bug reports, feature suggestions, or ideas provided to TAMGAMCAD by the user are considered entirely voluntary. TAMGAMCAD has the right to use and integrate these feedbacks into its commercial product without paying any royalties.

6. HIGH-RISK USE

The Software is not intended for the final approval of high-risk activities that could lead to death, personal injury, or severe physical/environmental damage, such as nuclear facilities, aircraft navigation and communication systems, air traffic control, direct life support machines, weapons systems, or architectural/engineering projects with a risk of structural collapse. The user is obligated to independently test the safety of the designs they create. TAMGAMCAD cannot be held responsible for production defects arising from design errors. It is the user's responsibility to have the drawings created with TAMGAMCAD further verified by authorized experts before they are used in production, construction, architectural application or engineering processes.

7. DISCLAIMER OF WARRANTIES AND FORCE MAJEURE

• Provided "As Is": This Software is provided "AS IS" with all faults. Regular backing up of drawings is entirely the user's responsibility.
• Force Majeure: TAMGAMCAD cannot be held responsible for service interruptions and data losses arising from 'Force Majeure' events beyond its control, such as natural disasters, war, cyberattacks, global internet outages, or the collapse of infrastructure providers (e.g., cloud servers).

9. COMMUNICATION, NOTIFICATIONS, AND FEEDBACK

TAMGAMCAD may send mandatory service messages (e.g., account security, critical updates) to your registered email. Additionally, you consent to receive informational emails regarding new features (e.g., Version updates, bug fixes) and user satisfaction surveys. You can opt-out of these promotional and informational emails at any time by sending an email to tamgamcad@hotmail.com or by replying to the received email with the word 'Unsubscribe'.

10. DISPUTE RESOLUTION AND PREVAILING LANGUAGE

The laws of the Republic of TÜRKİYE shall apply to the resolution of any legal disputes arising from this agreement, and the Courts and Execution Offices of İzmir are authorized. In the event of any difference in meaning or interpretation between the translations of this agreement in different languages, the Turkish text shall prevail.

TAMGAMCAD approaches the privacy of your personal data with the principle of "Privacy by Design". Our data processing procedures are carried out in consideration of the Republic of TÜRKİYE KVKK (Law No. 6698) and European Union GDPR standards.

1. COLLECTED DATA AND LOCAL STORAGE

• Account Information: The application only stores your email address for account verification and license management. Reliable third-party cloud providers (Firebase) are used for account verification and infrastructure services.
• Drawing Data: All your projects within TAMGAMCAD are saved entirely on your own device (LOCALLY). Your projects are not uploaded to, read, or stored by our servers.

2. CRASH REPORTS AND ANALYTICS

In order to improve the quality of the Software and fix bugs, when application crashes occur, your device model, operating system version, and anonymous log data at the time of the error may be automatically collected. This data is anonymous, does not contain your personal projects, and is used solely for technical improvements.

3. PAYMENTS AND THIRD-PARTY SERVICES

All purchasing transactions take place through the secure payment infrastructures of the relevant Platform (App Store). Your credit card or billing information is never seen or stored by us.

4. PURPOSE OF DATA USE AND AGE RESTRICTION

Your limited data is used to provide the application, verify subscriptions, and inform you about major application updates (e.g., new versions, bug fixes) or feedback surveys. You can unsubscribe from informational emails at any time by sending an email to tamgamcad@hotmail.com or replying to our emails. Your data is under no circumstances sold to third parties for advertising purposes.

• Age Restriction: TAMGAMCAD does not knowingly collect data from children under the age of 13. If you are under 13 (or the applicable age of majority in your country), you may only use the application under parental supervision.

5. USER RIGHTS AND DATA DESTRUCTION (DELETION)

• Data Destruction Period: When a user requests to delete their account, the email and basic system data linked to the account are permanently and irreversibly destroyed from all our databases within 30 days at the latest.
